These Terms of Service (“Terms”) govern access to and use of the websites, applications, automations, integrations, AI agents and related technology services provided by Kingdom Intelligence Group LLC (“Kingdom Intelligence Group”, “we”, “us”). By visiting our website, submitting a form, requesting a demonstration, or using any service we deliver, you agree to these Terms.

1. Acceptance of Terms

By using our website, requesting a demonstration, communicating with an automation or AI agent operated by us, or receiving any service from us, you accept these Terms. If you do not agree, do not use the services. If a separate written proposal, order form or agreement exists between you and Kingdom Intelligence Group, that document controls where it conflicts with these Terms.

2. Description of Services

We build and operate technology for businesses, which may include custom software and web systems, SaaS products, websites, workflow automation (including n8n automations), AI agents and assistants, AI voice and call demonstrations, messaging and customer communication systems, CRM-style workflows, and integrations with third-party platforms such as Meta (Facebook, Instagram, Messenger and WhatsApp), telephony providers and business tools. The specific scope of any engagement is defined in the applicable proposal, order or contract.

3. Eligibility and Authority

You must be of legal age in your jurisdiction to use the services. If you use the services on behalf of a business or other organization, you represent that you are authorized to act for that organization and to bind it to these Terms. You are responsible for the accuracy of the information you provide to us.

4. Accounts, Business Assets and Authorizations

Many services require connecting business assets such as social accounts, pages, business manager assets, phone numbers, mailboxes, CRM records or third-party API credentials. You are responsible for obtaining and maintaining all necessary rights, permissions and consents for the assets you connect, for the accuracy of the access you grant, and for revoking access when it is no longer appropriate. You must keep credentials confidential and notify us promptly of any suspected unauthorized access. We access connected assets only as needed to configure, operate, support and improve the services you requested.

6. Third-Party Platforms and Policy Compliance

Some services depend on third-party platforms, APIs and providers, including Meta (Facebook, Instagram, Messenger, WhatsApp), messaging, telephony, hosting, AI model providers and payment processors. Your use of those platforms is also subject to their own terms and policies, and you agree to comply with them. Platform providers may change, restrict, deprecate or suspend their APIs, features, message-window rules, template policies or account access at any time. Such changes may alter or interrupt functionality, and are outside our control.

7. AI Outputs and Automation Limitations

Our services may generate text, voice, summaries, classifications, recommendations or automated replies produced by artificial intelligence. AI systems can be inaccurate, incomplete, or unexpected, and automations can be affected by data quality, platform behavior, or configuration changes. AI outputs are not professional, legal, medical, financial or other regulated advice. You are responsible for how outputs are used in your business. For important, sensitive, contractual, regulated or high-risk communications, human review is appropriate and recommended before an automated message or decision is relied upon. Where required by law or platform policy, you are responsible for disclosing that a conversation is handled by an automated agent.

8. Customer Content and Data

You retain ownership of the content, records and data you or your customers provide or that our systems process on your behalf (“Customer Data”). You grant us the limited rights necessary to host, process, transmit and display Customer Data solely to deliver, support, secure and maintain the services you requested, and as otherwise permitted by our Privacy Policy. You are responsible for having the lawful basis and notices required to share Customer Data with us. Deletion requests are handled as described in the Data Deletion Instructions.

9. Intellectual Property

Kingdom Intelligence Group retains all rights, title and interest in its software, source code, platform, tooling, automation workflows, prompts, templates, architectures, documentation, know-how and any improvements or generalized learnings, including materials we develop or reuse across engagements. Nothing in these Terms transfers ownership of our intellectual property. You retain rights in your own brand assets, content and Customer Data. Any deliverable-specific license or assignment is defined in the applicable proposal, order or contract. You may not copy, modify, sublicense, or create derivative works of our platform or code except as expressly permitted in writing.

10. Confidentiality and Security

Each party agrees to protect non-public information disclosed by the other and to use it only for the purpose of the engagement. We apply reasonable technical and organizational measures appropriate to the nature of the services, such as access controls, role-based permissions and encrypted transport. No system or transmission method is completely secure, and we do not promise absolute security. You are responsible for the security of your own devices, accounts and connected platform credentials.

11. Availability, Changes, Suspension and Termination

Services are provided on an ongoing but evolving basis. We may modify, improve, or discontinue features, and may perform maintenance that temporarily affects availability. We may suspend or terminate access where there is suspected misuse, unlawful activity, security risk, third-party platform requirement, non-payment, or a material breach of these Terms. You may stop using the services at any time and revoke platform authorizations from your own business settings. Termination of a paid engagement is governed by the applicable proposal, order or contract. Provisions that by their nature should survive termination will survive, including intellectual property, confidentiality, disclaimers, limitation of liability and indemnity.

12. Fees and Payment

Fees, billing cycles, taxes, third-party pass-through costs, service scope, delivery timelines and other commercial terms are defined exclusively in the applicable proposal, order form or written agreement. No pricing, refund, credit, service-level or commercial commitment is created by this page or by our website content.

13. Disclaimers

Except as expressly stated in a signed agreement, the services are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the services will be uninterrupted, error-free or free of inaccuracies, that any automation or AI agent will produce a specific output, or that use of the services will produce any particular revenue, lead volume, conversion rate or other business result.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Kingdom Intelligence Group and its members, officers, employees and contractors will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, or business interruption, arising out of or relating to the services, even if advised of the possibility of such damages. To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the services is limited to the amounts actually paid by you to Kingdom Intelligence Group for the specific service giving rise to the claim during the period defined in the applicable agreement. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnity

You agree to defend, indemnify and hold harmless Kingdom Intelligence Group from claims, damages, liabilities, penalties and reasonable costs arising from your unlawful use of the services, your breach of these Terms or of third-party platform policies, your unauthorized use of accounts, assets or data, messaging you send or authorize, or content and data you provide.

16. Third-Party Services and Outages

The services may rely on infrastructure and providers we do not control. Interruptions, rate limits, policy enforcement actions, account restrictions, deprecations, data loss or degradation originating from a third-party provider are outside our reasonable control. We will make commercially reasonable efforts to restore, adapt or advise on alternatives, but we are not responsible for third-party failures or decisions.

17. Privacy and Data Deletion

Our Privacy Policy is incorporated into these Terms by reference and explains how we collect, use, retain and protect information, including Meta Platform Data. Anyone may request deletion, without an account or login, using the Data Deletion Instructions at https://kingdomintelligencegroup.com/data-deletion.

18. Changes to These Terms

We may update these Terms to reflect changes in our services, technology, third-party platform requirements or legal obligations. The “Last updated” date above indicates the latest revision. Continued use of the services after an update constitutes acceptance of the revised Terms.

3. Elegibilidad y autoridad

Debe tener la edad legal en su jurisdicción. Si actúa en nombre de un negocio u organización, declara que está autorizado para representarlo y obligarlo a estos Términos. Usted es responsable de la exactitud de la información que nos proporciona.

4. Cuentas, activos de negocio y autorizaciones

Muchos servicios requieren conectar activos como cuentas sociales, páginas, activos del business manager, números telefónicos, buzones, registros de CRM o credenciales de API de terceros. Usted es responsable de obtener y mantener los derechos, permisos y consentimientos necesarios, de la exactitud de los accesos otorgados y de revocarlos cuando ya no correspondan. Debe mantener las credenciales en confidencialidad y notificarnos cualquier acceso no autorizado. Accedemos a los activos conectados solo en la medida necesaria para configurar, operar, soportar y mejorar los servicios solicitados.

5. Uso aceptable

No puede usar los servicios para infringir leyes o derechos de terceros; enviar mensajería masiva no solicitada, spam o comunicaciones engañosas o fraudulentas; suplantar identidades o tergiversar un agente automatizado cuando la ley o la política de la plataforma lo prohíba; recopilar o procesar datos personales sin base legal o sin el consentimiento requerido; distribuir malware, vulnerar la seguridad, realizar ingeniería inversa, hacer scraping o interrumpir los servicios o la infraestructura de plataformas conectadas; acosar, discriminar o difundir contenido ilícito o abusivo; o revender, sublicenciar o proveer los servicios a terceros sin acuerdo escrito. Podemos investigar el uso indebido y adoptar medidas razonables, incluida la suspensión.

6. Plataformas de terceros y cumplimiento de políticas

Algunos servicios dependen de plataformas, API y proveedores de terceros, incluidos Meta (Facebook, Instagram, Messenger, WhatsApp), mensajería, telefonía, hosting, proveedores de modelos de IA y procesadores de pago. Su uso también está sujeto a los términos y políticas de dichas plataformas, que usted se compromete a cumplir. Los proveedores pueden cambiar, restringir, descontinuar o suspender API, funciones, ventanas de mensajería, políticas de plantillas o accesos en cualquier momento, lo que puede alterar o interrumpir la funcionalidad y está fuera de nuestro control.

7. Resultados de IA y límites de la automatización

Nuestros servicios pueden generar texto, voz, resúmenes, clasificaciones, recomendaciones o respuestas automatizadas mediante inteligencia artificial. La IA puede ser imprecisa, incompleta o inesperada, y las automatizaciones dependen de la calidad de los datos, del comportamiento de las plataformas y de la configuración. Los resultados de IA no constituyen asesoría profesional, legal, médica, financiera ni regulada. Usted es responsable del uso que haga de esos resultados. Para comunicaciones importantes, sensibles, contractuales, reguladas o de alto riesgo, la revisión humana es apropiada y recomendada. Cuando la ley o la plataforma lo exija, usted es responsable de informar que la conversación es atendida por un agente automatizado.

8. Contenido y datos del cliente

Usted conserva la titularidad del contenido, registros y datos que nos proporciona o que procesamos por su cuenta. Nos otorga los derechos limitados necesarios para alojar, procesar, transmitir y mostrar dichos datos únicamente para prestar, soportar, asegurar y mantener los servicios solicitados, y conforme a nuestra Política de Privacidad. Usted es responsable de contar con la base legal y los avisos necesarios. Las solicitudes de eliminación se atienden según las Instrucciones de eliminación de datos.

9. Propiedad intelectual

Kingdom Intelligence Group conserva todos los derechos sobre su software, código, plataforma, herramientas, flujos de automatización, prompts, plantillas, arquitecturas, documentación y conocimiento técnico, incluidas mejoras y aprendizajes generalizados. Nada en estos Términos transfiere nuestra propiedad intelectual. Usted conserva los derechos sobre su marca, contenido y datos. 10. Confidencialidad y seguridad

Cada parte protegerá la información no pública de la otra y la usará solo para el propósito del proyecto. Aplicamos medidas técnicas y organizativas razonables y proporcionales al servicio, como controles de acceso, permisos por rol y transporte cifrado. Ningún sistema es completamente seguro y no prometemos seguridad absoluta. Usted es responsable de la seguridad de sus dispositivos, cuentas y credenciales de plataformas conectadas.

11. Disponibilidad, cambios, suspensión y terminación

Los servicios evolucionan de forma continua. Podemos modificar, mejorar o descontinuar funciones y realizar mantenimientos que afecten temporalmente la disponibilidad. Podemos suspender o terminar el acceso ante uso indebido, actividad ilícita, riesgo de seguridad, exigencia de una plataforma de terceros, falta de pago o incumplimiento material. Usted puede dejar de usar los servicios en cualquier momento y revocar autorizaciones desde su propia configuración de negocio. La terminación de un servicio pagado se rige por la propuesta, orden o contrato aplicable. Las cláusulas que por su naturaleza deban sobrevivir seguirán vigentes.

12. Tarifas y pagos

Las tarifas, ciclos de facturación, impuestos, costos de terceros, alcance, plazos y demás condiciones comerciales se definen exclusivamente en la propuesta, orden o acuerdo escrito aplicable. Esta página y el contenido del sitio no crean precios, reembolsos, créditos ni compromisos de nivel de servicio.

13. Exenciones de garantía

Salvo lo expresamente pactado por escrito, los servicios se prestan “tal cual” y “según disponibilidad”, sin garantías expresas, implícitas o legales, incluidas las de comerciabilidad, idoneidad para un fin particular y no infracción. No garantizamos que los servicios sean ininterrumpidos o libres de errores, que una automatización o agente de IA produzca un resultado específico, ni que su uso genere ingresos, volumen de leads, conversiones u otros resultados de negocio determinados.

14. Limitación de responsabilidad

En la máxima medida permitida por la ley aplicable, Kingdom Intelligence Group y sus miembros, directivos, empleados y contratistas no serán responsables por daños indirectos, incidentales, especiales, consecuentes, ejemplares o punitivos, ni por pérdida de beneficios, ingresos, datos, reputación o interrupción del negocio. En la máxima medida permitida por la ley, nuestra responsabilidad total se limita a los importes efectivamente pagados por usted por el servicio específico que origina la reclamación durante el período definido en el acuerdo aplicable. 15. Indemnidad

Usted defenderá e indemnizará a Kingdom Intelligence Group frente a reclamaciones, daños, responsabilidades, sanciones y costos razonables derivados de su uso ilícito de los servicios, del incumplimiento de estos Términos o de las políticas de plataformas de terceros, del uso no autorizado de cuentas, activos o datos, de la mensajería que envíe o autorice, y del contenido y datos que proporcione.

16. Servicios de terceros e interrupciones

Los servicios pueden depender de infraestructura y proveedores que no controlamos. Interrupciones, límites de tasa, acciones de cumplimiento, restricciones de cuenta, descontinuaciones o pérdidas de datos originadas en un tercero están fuera de nuestro control razonable. Haremos esfuerzos comercialmente razonables para restablecer, adaptar o proponer alternativas, pero no somos responsables de fallos o decisiones de terceros.

17. Privacidad y eliminación de datos
